These Terms of Service (“Terms”) govern your access to and use of https://weldingequipment.co (the “Site”) and any purchase you make from Baker's Gas & Welding Supplies, Inc. (“we,” “us,” or “Baker's Gas”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility & Account Use
You must be at least 18 years old and able to form a binding contract to place an order. You are responsible for keeping any account credentials confidential and for all activity that occurs under your account.
2. Products & Availability
We are an authorized dealer for the manufacturers whose products we list. All products are subject to availability, and we may limit quantities, discontinue items, or correct errors in product descriptions or specifications at any time. Product images are representative; actual items may vary slightly in appearance.
3. Pricing
All prices are listed in U.S. dollars and are subject to change without notice. Prices shown at the time you place an order apply to that order. We make every effort to ensure pricing is accurate; in the event of a pricing error, we reserve the right to cancel or refuse any order placed at the incorrect price and to notify you so you can decide whether to proceed at the corrected price. Applicable sales tax and shipping are calculated at checkout.
4. Orders, Invoicing & Payment
When you place an order on the Site, you are submitting an offer to purchase. We confirm stock and pricing and then issue an itemized invoice to the email you provide. No payment is collected on the Site at the time of order — payment is made against the invoice via the method you select (secure card/ACH pay link, financing through Affirm or QuickSpark, bank transfer, or payment at pickup). An order is not binding on us until we accept it and issue the invoice. We may refuse or cancel any order at our discretion, including for suspected fraud or pricing error.
5. Shipping & Delivery
We ship within the United States. Estimated delivery times are provided in good faith but are not guaranteed. Risk of loss passes to you upon delivery to the carrier. Free standard shipping applies to qualifying orders over $150; orders below that threshold are charged shipping calculated at checkout. Oversized items may ship via freight with separate scheduling.
6. Returns & Refunds
Returns are governed by our Returns & Exchanges policy. In summary, unused items in original packaging may be returned within 30 days of delivery, subject to manufacturer-specific restrictions on certain items and consumables.
7. Manufacturer Warranties
Products are covered by the applicable manufacturer's warranty. Because we are an authorized dealer, every machine ships brand-new and the manufacturer's warranty applies from your purchase date. We make no separate warranty beyond the manufacturer's, and we disclaim all implied warranties to the fullest extent permitted by law.
8. Acceptable Use
You agree not to misuse the Site, interfere with its operation, attempt to gain unauthorized access, scrape content for competing commercial use, or use the Site in violation of any applicable law. Welding equipment must be operated safely and in accordance with manufacturer instructions and OSHA/ANSI guidelines; you are responsible for safe use.
9. Limitation of Liability
To the fullest extent permitted by law, Baker's Gas is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products purchased, including damages resulting from improper use of welding equipment. Our total liability for any claim is limited to the amount you paid for the product giving rise to the claim.
10. Intellectual Property
All content on the Site — text, graphics, logos, and original product descriptions — is owned by Baker's Gas & Welding Supplies, Inc. or its licensors and may not be copied or reused without permission. Manufacturer brand names and trademarks remain the property of their respective owners and are used to identify the products we sell as an authorized dealer.
11. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Michigan.
12. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
